A South Daytona man faces numerous felony charges after a dispute between him and an ex-girlfriend ends with her shot in one of her legs.
42-year-old Martin Rubin will be charged with aggravated battery and aggravated battery with a firearm following an incident this morning (November 18, 2020) on a public sidewalk just southwest of South Dr. Martin Luther King (MLK) Jr. Boulevard and Bellevue Avenue.
Rubin will also be charged with firearm possession since he’s a convicted felon.
Additional charges are possible once detectives complete the investigation.
A 911 call placed at 10:52 a.m. sent officers with the Daytona Beach Police Department (DBPD) to the intersection of MLK and Bellevue, where the victim – a 31-year-old South Daytona woman – was found with a gunshot wound in her right leg.
Paramedics took the woman from the scene to Halifax Health Medical Center for treatment. Her injuries are not life-threatening.
The victim told officers that she had recently broken up with Rubin and was on the sidewalk when Rubin arrived on scene, got out of a blue Nissan and confronted her.
It’s unclear at this time if Rubin knew she was going to be there or if they just ran into one another.
Words were exchanged between Rubin and the victim before he attacked her physically and then shot her with a gun he had in his possession. He then fled the scene in the Nissan.
Within an hour, officers tracked Rubin down to his home at the Bristol Bay condominiums in South Daytona.
Rubin fled from his home on foot soon after officers with DBPD and the South Daytona Police Department arrived, but he was caught minutes later near the intersection of Big Tree Road and the Florida East Coast railroad tracks.
